Group B Arrests (357 Arrests):

  • Disorderly Conduct: 36 arrests
  • DUI: 118 arrests
  • Liquor Law Violations: 8 arrests
  • Trespass: 18 arrests
  • All Other Offenses: 175 arrests.

How Long Do Arrests Stay on Your Record?

Indefinitely. Since there are no time limits for keeping arrest records in Arkansas, these records stay on file indefinitely unless a person takes legal action to have them removed through expungement or sealing under Ark. Code Ann. § 16-90-1401, et seq. Otherwise, law enforcement agencies retain these records and release them to the public upon request under the state’s Freedom of Information Act (FOIA).

Expunge Boone County Arrest Records

Arkansas law restricts or exempts arrest records from public disclosure through sealing and destroys arrest records through expungement. Arkansas allows expungement only for juvenile records under Ark. Code Ann. § 9-27-309(b), while adult arrest records can only be sealed.

The Comprehensive Criminal Record Sealing Act of 2013 (Ark. Code Ann. § 16-90-1401, et seq.) outlines eligible offenses (arrests) for sealing, including arrests without charges after one year, arrests with dismissed or acquitted charges, first-time offenses with deferred sentences, misdemeanor arrests, nonviolent Class C or D felony arrests, certain drug-related felony arrests, unclassified felony arrests, and arrestees with pardoned convictions.

To seal eligible arrest records, download the appropriate petition form from the ACIC Forms Page, fill it out, and file it with the Circuit or District Court in Boone County where the charges were filed following their arrest.

The completed petition along with every applicable supporting document, such as proof of sentence completion, payment records from the sheriff’s department, probation completion certificates, criminal history records from the Arkansas Crime Information Center (ACIC), etc., should be submitted to the Circuit or District Court in Boone County, including providing copies to the arresting agency and prosecuting attorney's office.

The prosecuting attorney has 30 days to object to sealing a misdemeanor and 90 days for a felony. If approved, the court issues an order to seal the arrests. The court clerk sends copies of this order to the relevant custodians of the related records (i.e., the Boone County Sheriff's Office and ACIC). However, if the petition is denied, the petitioner can file again after one year from the date of the denial.
