Indefinitely. Records of arrests remain public information indefinitely until they are sealed or expunged. Any person who has been arrested and charged for a criminal offense, whether a felony or misdemeanor, may petition the court in the county where the charge was filed to have the records and all related documents expunged if the charges were dropped or dismissed or the individual was acquitted at trial (A.C.A. § 16-90-906).

Where a person has completed a drug court program and received aftercare programming, they may be eligible to have their arrest records expunged. However, the judge must receive a recommendation from the prosecuting attorney stating assenting to the expungement and dismissal of the case (A.C.A. § 16-98-303(g)). This will, however, not apply if the petitioner has pled guilty or nolo contendere to a burglary or breaking and entering charge or has more than four offenses of driving with influence (DWI).

Once a uniform order for expungement is entered under this act, the person whose record is sealed will have all their rights and privileges restored. The record that is now sealed shall not affect any of their rights and privileges except where the law provides otherwise. It will be deemed that the record does not exist and that the arrest never occurred (AR Code § 16-90-1417).

An arrest warrant issued must state the full name of the defendant, where his name is unknown, any name or description by which the defendant can be identified with reasonable certainty, and the defendant's location. It shall also state the offense with which the defendant is charged and an instruction that the defendant be arrested and brought before the issuing judge or the nearest or most accessible judge with jurisdiction over the matter.

Do Mississippi County Arrest Warrants Expire?

Arrest warrants do not expire. Once a warrant is issued in Arkansas, it remains active until a judge recalls it or the case is resolved or recalled. There is no statute of limitations for warrants. Regardless, law enforcement officers are obligated to apprehend the suspect within a reasonable timeframe. If an individual suspects or knows that a warrant has been issued for their arrest, the best step is to contact an attorney to explore their options for resolving the warrant. Evading arrest may lead to a separate charge or additional penalties.
